1. Who we are
Clipform is a video-driven form builder operated by Reco Ventures Ltd., a company registered in the United Kingdom("we", "us"). By creating an account or using the service, you agree to these terms. You must be at least 18 years old to hold an account.
2. The service
Clipformlets you build forms and collect responses from the people you share them with ("respondents"), including text, audio, and video responses. Features and usage limits depend on your plan, and we may enforce those limits.
Where you connect Clipformto a third-party platform (for example by installing our Shopify app), your use of that platform remains subject to the platform's own terms, and we are not responsible for the platform or for changes it makes. We may suspend or withdraw an integration if the platform requires it.
Clipform also offers an API and integrations that let you connect Clipformto external services - such as automation and workflow tools - and send your form responses to services you choose. Your use of the API and any integration is subject to these terms and to any documented usage limits, and you are responsible for the destinations you connect and for the data once we have delivered it to them. We may change, rate-limit, or withdraw API access or an integration where reasonably needed to protect or maintain the service.
3. Accounts
You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorised use.
4. Billing
Paid plans are monthly recurring subscriptions billed in advance through our payment processor, or through a platform's billing system where you subscribe via an app marketplace (for example the Shopify App Store), in which case that platform's billing terms also apply. Your subscription renews automatically each month until you cancel. Cancellation takes effect at the end of the current billing period; you keep access until then. Payments are non-refundable, except where we choose to issue a refund at our sole discretion or where a refund is required by law. We may change prices with reasonable advance notice; changes apply from your next billing period.
5. Your content
You own the forms you create and the responses you collect. You grant us a worldwide, non-exclusive licence to host, process, transmit, and display that content to provide, support, and improve the service. This includes creating aggregated or de-identified data that does not identify you or your respondents, which we may use and publish for any purpose, including improving and promoting the service and publishing insights and benchmarks. We claim no other rights in your content.
6. Your responsibilities as a form owner
Where your forms collect personal data from respondents, you are the data controller of that data and we process it on your behalf. You are responsible for having a lawful basis to collect it, for providing respondents with any required privacy information, for obtaining any consents required for special categories of data (including video or audio recordings of individuals), and for ensuring the content you upload or collect does not infringe any third party's rights or any law. You will defend and indemnify us against third-party claims arising from your content, your forms, or your breach of these terms.
7. Acceptable use
You must not use the service to do anything unlawful, to send spam, to collect data you are not entitled to collect, to infringe intellectual property rights, or to interfere with or disrupt the service or its security. You must not use forms to collect passwords or login credentials, payment card numbers, or government-issued identification numbers or documents. We may remove content, and suspend or terminate accounts, that breach this section, and we may suspend the service without liability while we address attacks or abuse targeting it.
8. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and uninterrupted availability. Experimental or beta features may be modified or withdrawn at any time without notice. Nothing in these terms excludes liability that cannot be excluded by law, or affects statutory rights you have as a consumer that cannot be waived.
9. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, or goodwill; and (b) our total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim.
10. Termination
You may close your account at any time. We may suspend or terminate your access for breach of these terms. On account deletion, your content is deleted in accordance with our Privacy Policy. Sections 5, 6, 8, 9, and 11 survive termination.
11. Changes, law, and contact
We may update these terms; if changes are material we will give you reasonable notice, and continued use after they take effect constitutes acceptance. These terms are governed by the laws of England and Wales, and its courts have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
